DECLARING CERTAIN PARCELS OF LAND OF THE PUBLIC DOMAIN SITUATED IN BARANGAY VI-A, VICTORIAS CITY, NEGROS OCCIDENTAL AS SOCIALIZED HOUSING SITE FOR DISPOSITION TO BONAFIDE OCCUPANTS IN ACCORDANCE WITH REPUBLIC ACT NO. 730, IN RELATION TO THE PROVISIONS OF THE PUBLIC LAND ACT (COMMONWEALTH ACT NO. 141, AS AMENDED)
Upon the recommendation of the Secretary of Environment and Natural Resources, and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of the Philippines, do hereby declare a certain parcel of land situated in Barangay VI-A, Victorias City, Negros Occidental as socialized housing site and open to disposition to the actual occupants, in accordance with Republic Act No. 730, in relation to the provisions of the Public Land Act (Commonwealth Act No. 141, as amended), subject to private rights, if any there be, and to final survey. The subject parcel of land comprising an area of 413,093 square meters? more or less, is more particularly described as follows:
A PARCEL OF LAND (Plan of Land, Ng-06-000029), situated at Barangay VI-A, Victorias City, Negros Occidental. Bounded on the SE., along line 1-2 by Lot 216; along lines 2-3-4-5-6 by Lot 92 both of Cad. 57, Victorias Cadastre; along line 6-7 by Public Land; on the SW., and NW., along lines 7-8-9-10-11-12-13-14-15-16-17-18-19-20-21-22-23-24-25-26-27-28-29-30-31-32-33-34-35-36-37-38-39-40-40-41 by Malihao River; on the NW., NE., and SE., along lines 41-42-43-44-45-46 by Visayan Sea; on the SE., along lines 46-47-48-49-50-51 by Public Land; along 51-1 by Lot 216, Cad. 57, Victorias Cadastre.1aшphi1

All corners referred to are indicated on plan and are marked on the ground as follows: point 1 to 6 by Old points, points 47 to 50 by P.S. cyl. conc. Mons. 15 x 40 cm., and the rest by stakes, bearings grid, surveyed on August 12-14, 1996 and approved on January 21, 2000.
Such part or parts of the area herein declared open to disposition which are being used or earmarked for public or quasi-public purposes shall be excluded from such disposition. Except in favor of the Government or any of its branches or agencies, all land disposed of under this proclamation shall not be subject to alienation and encumbrance for a period of ten (10) years from the issuance of title in case of sale, or execution of contract in case of lease, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of said period; but the improvements on the land may be mortgaged to qualified persons, associations or corporations.
The Department of Environment and Natural Resources shall conduct or supervise the actual boundary and subdivision survey of the proclaimed area and shall upon approval thereof, issue the corresponding special patent.
An Inter-Agency Committee to be composed of the HUDCC, DENR, PCUP, NHA, City Government of Victorias and concerned NGO/PO shall be created to formulate the guidelines for the disposition and implementation of a comprehensive housing plan for the area.
