DESIGNATING AND DEFINING A PORTION OF THE PHILIPPINE COCONUT AUTHORITY RESEARCH CENTER SITUATED IN SAN RAMON, ZAMBOANGA CITY, AS PART OF THE ZAMBOANGA CITY SPECIAL ECONOMIC ZONE AND FREEPORT
WHEREAS, Section 3 of Republic Act No. 7903 creating the Zamboanga City Special Economic Zone and Freeport (ZAMBOECOZONE) provides that the specific metes and bounds of the ZAMBOECOZONE shall be defined in a Presidential Proclamation to be issued for this purpose;
WHEREAS, Section 7 of Republic Act No. 7903 vests in the Zamboanga City Special Economic Zone Authority (ZAMBOECOZONE Authority) the power, among others, to (i) recommend to the President the issuance of a proclamation fixing and delimiting the site of the ZAMBOECOZONE; (ii) make contracts; and (iii) own or otherwise dispose of personal or real property;
WHEREAS, Section 3(l) of Presidential Decree No. 1468 amending the Charter of the Philippine Coconut Authority (PCA) vests in the PCA the power, among others, to enter into, make and execute contracts of any kind as may be necessary or incidental to the attainment of its purposes and, generally, to exercise all the powers necessary to achieve the purposes and objectives for which it is organized;
WHEREAS, on August 18, 2001, the Board of Directors of the ZAMBOECOZONE Authority resolved to recommend to the President the issuance of a Presidential Proclamation designating and defining the Ten and 14/100 (10.14) hectares of land of the PCA Research Center situated in San Ramon, Zamboanga City, as an integral part of the ZAMBOECOZONE;
WHEREAS, on August 31, 2001, a Memorandum of Agreement was executed between the PCA and the ZAMBOECOZONE Authority providing that, among others, (i) the PCA is the lawful possessor/user of certain parcels of land by virtue of Proclamation No. 1025, situated at San Ramon, Zamboanga City, with an area of Four Hundred Twenty-five (425) hectares; and (ii) the PCA agrees to transfer portions of the land occupied by the PCA Research Area in San Ramon, Zamboanga City, consisting of Ten and 14/100 (10.14) hectares to the ZAMBOECOZONE Authority;
WHEREAS, on August 31, 2001, a Deed of Assignment was executed between the PCA and the ZAMBOECOZONE Authority which provides, among others, that (i) the PCA is the lawful possessor/user of certain parcels of land by virtue of Proclamation No. 1025, situated at San Ramon, Zamboanga City, with an area of Four Hundred Twenty-Five (425) hectares; (ii) the PCA voluntarily and freely transfers and conveys a portion of the aforementioned parcels of land consisting of Ten and 14/100 (10.14) hectares to the ZAMBOECOZONE Authority; (iii) the Ten and 14/100 (10.14) hectares transferred by the PCA to the ZAMBOECOZONE Authority shall be used in furtherance of the operation and development of the ZAMBOECOZONE Authority;
NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, by virtue of the powers vested in me by law and upon the recommendation of the ZAMBOECOZONE Authority, do hereby designate the area consisting of Ten and 14/100 (10.14) hectares of the PCA Research Center, San Ramon, Zamboanga City, hereinafter particularly described, to constitute and form an integral part of the ZAMBOECOZONE, and further authorize and direct the transfer of said property, with all the improvements thereon, to the ZAMBOECOZONE Authority for the purpose of implementing Republic Act No. 7903, to wit:
