Proclamation No. 428

CALLING THE NATIONAL ASSEMBLY IN SPECIAL SESSION FOR A PERIOD OF FIVE DAYS BEGINNING AUGUST 15, 1939

Whereas the Congress of the United States has enacted, and the President has on the seventh day of August, nineteen hundred and thirty-nine, approved a law entitled "An Act to amend an Act entitled ‘An Act to provide for the complete independence of the Philippine Islands, to provide for the adoption of a constitution and a form of government for the Philippine Islands, and for other purposes'"; and

Whereas section seven (a) of the said Act of Congress approved August seventh, nineteen hundred and thirty-nine, provides that sections one to five, inclusive, thereof shall become effective on January first, nineteen hundred and forty, if before that date subsection five of section one of the Ordinance Appended to the Constitution of the Philippines shall have been amended in the manner now provided by law, by changing the final period of said subsection to a comma, and by adding thereto the words: "as amended by the Act of Congress of the United States approved August seventh, nineteen hundred and thirty-nine," and section three of the said ordinance shall have been amended by inserting immediately after the words "approved March twenty-fourth, nineteen hundred and thirty-four" the same amendatory language mentioned above; and

Whereas it is in the public interest that said sections one to five, inclusive, of the said Act of Congress shall become effective on January first, nineteen hundred and forty;

Now, therefore, I, Manuel L. Quezon, President of the Philippines, by virtue of the power vested in me by the Constitution, do hereby call the National Assembly in special session in the City of Manila for a period of five days, commencing on the fifteenth day of August, nineteen hundred and thirty-nine, at four o’clock in the afternoon, for the purpose of considering such amendments to the Constitution of the Philippines as will make operative the said sections one to five, inclusive, of the aforesaid Act of Congress approved August seventh, nineteen hundred and thirty-nine, and such other amendments as the National Assembly may deem necessary; and also for the purpose of considering such measures’ as the Chief Executive may from time to time recommend.

All persons entitled to act as members of the Second National Assembly are required to take notice of this proclamation.
