AMENDMENT OF MEMORANDUM ORDER NO. 82 s. 2015 IN VIEW OF THE APPOINTMENT OF ATTY. MILDRED YOVELA S. UMALI-HERMOGENES AS DEPUTY EXECUTIVE SECRETARY FOR LEGAL AFFAIRS (DESLA)

WHEREAS, Memorandum Order (MO) No. 82 s. 2015 issued by the Executive Secretary granted then DESLA Menardo I. Guevarra authority, among others, to: (i) decide, approve and sign specific documents in the Office of the President (OP); (ii) represent the Executive Secretary in particular governmental bodies and committees; (iii) be a member of certain committees and technical working groups; and/or (iv) perform other functions as specified by the Executive Secretary.

WHEREAS, on 01 February 2016, Atty. Mildred Yovela S. Umali-Hermogenes was appointed as DESLA, and on 09 February 2016 she assumed the functions of the said office;

WHEREAS, there is a need for a comprehensive transfer of the specific grant of authorities, functions, committee memberships from DESLA Guevarra to DESLA Mildred Yovela S. Umali-Hermogenes; and

WHEREAS, Section 27, Chapter 9, Title III, Book III of Executive Order No. 292, otherwise known as the “Administrative Code of 1987”, empowers the Executive Secretary to exercise supervision and control over the various units in the OP Proper, including their internal administrative requirements, and to determine and assign matters to the appropriate units in the OP;

NOW, THEREFORE, I, PAQUITO N. OCHOA, JR., by the powers vested in me by law, do hereby order the following:

Section 1. TRANSFER OF AUTHORITIES, FUNCTIONS, AND COMMITTEE MEMBERSHIPS.

1.1 MO No. 82 which granted then DESLA Guevarra authority to decide, approve, and/or sign various matters in the OP under the following issuances: MO No. 77 s. 2015, MO No. 47 s. 2012, and Memorandum from the Executive Secretary dated 01 July 2011; Special Order (SO) No. 302 s. 2014; SO No. 218 s. 2014 and SO No. 137 s. 2014; Memorandum from the Executive Secretary dated 14 July 2011 for Secretary of Finance Cesar V. Purisima and Letter dated 29 June 2011 to the Country Director of the World Bank; and Letter dated 29 June 2011 to Land Bank Malacañang Extension Branch Head Marissa A. Garduque, is hereby amended so as to grant DESLA Mildred Yovela S Umali-Hermogenes the authority to decide, approve and/or sign the matters stated in the aforesaid issuances;

1.2 MO No. 82 which designated then DESLA Guevarra to various committees and bodies within and outside the OP under the following issuances SO No 514 s 2014; SO No. 141 s. 2014; SO No. 513 s. 2012, SO No. 93 s 2012 and SO No 603 s. 2011, SO No. 188 s. 2012; SO No. 414 s. 2011; SO No. 309 s 2011- Office Order (OO) No. 35 s. 2015; Memorandum from the ES dated 28 October 2011, and Letter to Secretary of Justice Leila M. De Lima dated 29 July 20 1 ?s hereby amended as to transfer to DESLA Mildred Yovela S. Umali-Hermogenes the authority to represent the Executive Secretary, and to be a member in the committees, teams, and technical working groups specified in the aforesaid issuances,

1.3 MO No. 82 which assigned additional functions to then DESLA Guevarra as part of the operational arrangements in the Office of the Executive Secretary including the matter stated in OO No. 23 s. 2012, is hereby amended as to transfer to DESLA Mildred Yovela S. Umali-Hermogenes the functions specified in the said issuance;

1.4 All other MOs, SOs, OOs, memoranda, letters of instructions, and other orders granting authorities and designating functions specifically to DESLA Guevarra are also amended as to transfer to DESLA Mildred Yovela S. Umali-Hermogenes the authorities and functions specified in the said issuances.

Section 2. POWER OF THE EXECUTIVE SECRETARY

It is understood that the transfer of authorities and functions in this Order does not preclude the Executive Secretary from directly performing the same authorities and functions at his discretion.

Section 3. BONDS AND OTHER ADMINISTRATIVE REQUIREMENTS

It is also understood that the necessary administrative requirements for the discharge of the authorities and functions transferred herein, including the posting of a bond as prescribed by applicable rules and regulations, shall be complied with.

Section 4. REPEALING CLAUSE

All MOs, SOs, OOs, circulars, rules, regulations and issuances, or parts hereof, which are inconsistent with the provisions of this Memorandum Order are hereby repealed or modified accordingly.1aшphi1

Section 5. EFFECTIVITY

This Memorandum Order shall take effect immediately.
