[ MEMORANDUM ORDER NO. 48, August 23, 2012 ]

VESTING ADDITIONAL DUTIES IN THE EXECUTIVE SECRETARY PENDING THE APPOINTMENT OF A SECRETARY OF THE INTERIOR AND LOCAL GOVERNMENT

WHEREAS, the tragic death of the Honorable Jesse M. Robredo has caused a sudden vacancy in the position of Secretary of Interior and Local Government;

WHEREAS, the President has the power of control over all executive departments, which power, pursuant to Executive Order No. 292 series of 1987 (Administrative Code), includes the authority to act directly whenever a specific function is entrusted by law or regulation to a subordinate; and,

WHEREAS, the duties of the Executive Secretary under the Administrative Code include the duty to directly assist the President in the management of affairs pertaining to the Government of the Republic of the Philippines and to perform such other functions as the President may direct.

NOW, THEREFORE, by virtue of the powers vested in me by the Constitution and by law, I, BENIGNO S. AQUINO III, President of the Philippines, hereby authorize Executive Secretary Paquito N. Ochoa, Jr. to temporarily perform, in addition to his current functions, the following duties pertaining to the Department of the Interior and Local Government (DILG), effective until the appointment of a new Secretary of the Interior and Local Government or the designation of an Acting/OIC Secretary over the same Department, to wit:

1. Establish appropriate policies and standards for the effective and efficient operations of the DILG;

2. Promulgate policies, rules, and regulations necessary in carrying out the goals and objectives of the DILG;

3. Exercise supervision and control over all offices within the DILG;

4. Exercise jurisdiction over all bureaus, offices, agencies and corporations under the DILG in accordance with the applicable relationship between such entities and the DILG (i.e. supervision and control, administrative supervision, or attachment);

5. Delegate duties, powers and authority to officers in the DILG whenever necessary;

6. Appoint officers and employees of the DILG; and,

7. Perform such other functions pertaining to the DILG and the bureaus, offices, agencies and corporations under it as may be directed by the President.1âшphi1
