[ Memorandum Order No. 26, August 10, 1992 ]

DESIGNATING THE SUBIC BAY METROPOLITAN AUTHORITY (SBMA) TO OVERSEE THE TURNOVER OF SUBIC NAVAL BASE AND ITS FACILITIES

In line with the enactment into law of Republic Act No. 7227, otherwise known as the Bases Conversion Development Authority, which provides for the creation of the Subic Bay Metropolitan Authority (SBMA), and in view of the phased withdrawal of the US forces from the base before 31 December 1992, the SBMA is hereby designated to oversee the said base and its facilities. As such, the SBMA is tasked to perform the following functions, to wit:

1. To receive and hold all the assets of the base that will be turned over by the US to the Philippine government;

2. To preserve, secure, maintain, develop and implement appropriate disposition arrangements of base assets. The SBMA and the Presidential Task Force for Bases Conversion/Special Operations Team under the Office of the President (pending the organization of the BCDA) are hereby authorized to appropriate the necessary funds for this purpose, consistent with pertinent auditing and accounting rules and regulations. To ensure the proper implementation of the abovementioned task, the SBMA is hereby empowered to engage the services of appropriate consultancy, security, operation and maintenance firms; and

3. To implement the base conversion program in consultation with the Task Force on Bases Conversion in line with its powers and functions as provided under Section 13 of Republic Act No. 7227.

In pursuit of the abovementioned tasks, the SBMA is hereby ordered to work in close coordination with the Presidential Task Force for Bases Conversion, Department of National Defense, Department of Interior and Local Government, Department of Foreign Affairs and Department of Finance/Bureau of Customs.

This Memorandum Order shall take effect immediately.
