[ Memorandum Order No. 298, June 4, 1990 ]

DIRECTING THE DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES TO ADOPT REASONABLE AND NECESSARY MEASURES TO REGULATE THE UTILIZATION AND EXPLOITATION OF FOREST RESOURCES.

WHEREAS, Section 2, Article XII of the Constitution provides, among others, that “. . . [t]he exploration, development and utilization of natural resources shall be under the full control and supervision of the State. . . .”;

WHEREAS, the present excessively low fees and charges being collected on timber and other forest products have encouraged indiscriminate, inefficient and wasteful utilization resulting to overexploitation and destruction of our valuable forest resources;

WHEREAS, the continued destruction of our remaining forest resources has seriously impaired the future supply of timber and wood building materials and at the same time has resulted in environmental degradation to the detriment of the social economic development of the nation;

WHEREAS, the causes of the inefficient, wasteful utilization and overexploitation of our forest resources must be addressed firmly and resolutely by the government;

NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, by virtue of the powers vested in me by law, do hereby order:

Section 1.The Secretary of Environment and Natural Resources is hereby directed to adopt reasonable and necessary measures to regulate the exploitation and utilization of forest resources for their efficient and effective protection, management and development, and impose the regulatory fees and charges therefor.

Section 2.This Memorandum Order shall take effect immediately.1aшphi1
