CREATING A COMMITTEE TO INVESTIGATE THE CONTROVERSY INVOLVING THE STA. INES MELALE FOREST PRODUCTS CORPORATION AND THE MASAO INTEGRATED PORT SERVICES.

The Sta. Ines Melale Forest Products Corporation, In Its petition dated November 25, 1981, seeks to set aside the Resolutions of this Office, dated July 2, 1981 and November 16, 1981, and to restore and maintain the decision of this Office dated August 11, 1978, In relation to O.P. Case No. 0682, entitled “STA. INES MELALE FOREST PRODUCTS CORPORATION, Petitioner, versus, PHILIPPINE PORTS AUTHORITY, Respondent, MASAO INTEGRATED PORT SERVICES INCORPORATED, Intervenor,” alleging In support thereof (1) that the desired Integration policy has not really worked In the Port of Masao; (2) that the petitioner Is not a competitor of the Masao Integrated Port Services; (3) that the reversal of the decision of August 11, 197 8 In the aforementioned case adversely affects the cost reduction program of the .pet it Loner; and (4) that res judicata has set in with respect to the aforesaid decision.

In view thereof, there is hereby created a Committee to investigate the controversy between the Sta. Ines Melale Forest Products Corporation and the Masao Integrated Port Services Incorporated  composed of the following officials: (1) A representative from the Office of the Solicitor General, who shall be designated by the Solicitor General and shall be the Chairman; Atty. Genaro Eslava, Officer-in-Charge, Legal Office, Office of the President) Vice Chairman, (3) a Representative from the Office of the Presidential Executive Assistant, Member; and (4) A Representative from the Philippine Ports Authority, Member.

As constituted, the Committee shall conduct an in-depth and comprehensive investigation of the controversy involving the Sta.1aшphi1 Ines Melale Forest Products Corporation and the Masao Integrated Port Services, Incorporated, In order to have a proper resolution of the issues raised in the aforementioned petition and to settle the aforesaid controversy in a final and just manner. For purposes of such investigation, the Committee Is authorized to call upon any Ministry, Bureau, Office, Agency or Instrumentality of the National Government as may be needed to ensure speedy and expeditious completion of its task. The Committee shall submit to the President, through the undersigned, a report containing its findings and recommendations within a period of thirty (30) days from the date hereof.

All expenses Incurred In connection with this Order shall be chargeable against the appropriation of the respective offices of those listed above, subject to the usual accounting and auditing requirements.
