[ EXECUTIVE ORDER NO. 90 ]
TRANSFERRING THE ATTACHMENT OF, AND REORGANIZING THE PRESIDENTIAL LEGISLATIVE LIAISON OFFICE
WHEREAS, Memorandum Order (MO) No. 128 (s. 1987), as amended by M? No. 142 (s. 1987), established the Presidential Legislative Liaison Office (PLLO) to promote Presidential initiatives, act as a conduit between the Office of the President (OP) and the individual members of Congress, serve as Presidential Adviser on Legislative Affairs, and monitor the progress of Administration bills;
WHEREAS, under MO No. 128, as amended, the PLLO shall be headed by a Presidential Legislative Liaison Officer with the rank of Undersecretary;
WHEREAS, MO No. 3 (s. 1998) created the position of the Presidential Adviser on Legislative Affairs, with the rank of Secretary, to head the PLLO, who shall be assisted by two (2) Deputies, one for each chamber of Congress, with the rank of Undersecretary;
WHEREAS, Executive Order (EO) No. 344 (s. 2004) abolished the Legislative Secretariat of the OP and transferred its mandates to the PLLO;
WHEREAS, EO No. 11 (s. 2022) placed the PLLO under the supervision and control of the Office of the Special Assistant to the President as part of streamlining the administrative structure of the OP;
WHEREAS, the Administration's Eight-Point Socioeconomic Agenda includes improving bureaucratic efficiency and one of the overarching goals of the Philippine Development Plan 2023-2028 is advancing good governance and accountability;
WHEREAS, it is imperative to reorganize the PLLO to streamline and rationalize its functions consistent with the rightsizing policy of the Administration towards bureaucratic coherence, and to enable the PLLO to more effectively and efficiently deliver the President's legislative agenda for the country;
WHEREAS, Section 31, Chapter 10, Title III, Book III, of EO No. 292 or the "Administrative Code of 1987" provides that the President, in order to achieve simplicity, economy and efficiency, shall have the continuing authority to reorganize the administrative structure of the OP; and
WHEREAS, under Section 93 of the General Provisions of Republic Act No. 12116 or the "General Appropriations Act for Fiscal Year 2025," the President is authorized to create new offices and modify the existing organizational structure of the agencies in the Executive branch, as well as create new positions or modify existing ones whenever public interest so requires;
NOW, THEREFORE, I, FERDINAND R. MARCOS, JR., President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:
Section 1. Reorganization. The Presidential Legislative Liaison Office shall be under the supervision and control of the Office of the Executive Secretary as one of the delivery units of the OP Proper. The position of the Presidential Adviser on Legislative Affairs with the rank of Secretary is hereby abolished.(awÞhi( The PLLO shall be headed by an Undersecretary who shall be assisted by two (2) Assistant Secretaries, one for the Senate and one for the House of Representatives.
Upon the effectivity of this Order, the relevant mandates of the Administrative, Financial and Management Division of the PLLO shall be performed by the Office of the Deputy Executive Secretary for Finance and Administration (ODESFA) and the Office of the Deputy Executive Secretary for Support Services and Auxiliaries (ODESSSA), as may be appropriate. For this purpose, and in accordance with their respective mandates, the ODESFA and ODESSSA shall ensure the proper turn-over of records, properties and resources of the PLLO to the OP Proper, subject to relevant laws, rules and regulations.
Section 2. Organizational Structure and Staffing Pattern. The Executive Secretary shall have the authority to assess and evaluate the organizational structure, staffing pattern and the corresponding qualification standards for all positions in the PLLO, and on the basis thereof, implement personnel actions and reorganization measures as may be necessary, and craft the organizational structure and staffing pattern of the PLLO, in accordance with relevant laws, rules and regulations.
In the exigency of service, and pending approval of the new organizational structure and staffing pattern, the PLLO and its existing personnel shall continue to operate and function under their existing mandates as prescribed by relevant laws, rules and regulations.
Section 3. Funding. The funds necessary for the implementation of this Order shall be charged against the budget of the PLLO, subject to relevant budgeting, accounting, and auditing rules and regulations. Thereafter, the subsequent funding requirements for the purpose shall be included in the budget proposal of the ?P, subject to the usual budget preparation process.
Section 4. Implementation. The Executive Secretary may issue Orders necessary to effectively implement this Order.
Section 5. Separability. If any section or part of this Order is declared unconstitutional or invalid, the other sections or provisions not otherwise affected shall remain in full force and effect.
Section 6. Repeal. EO No. 344 (s. 2004), EO No. 11 (s. 2022), and MO No. 3 (s. 1998) are hereby amended. All other issuances, orders, rules and regulations, or parts thereof that are inconsistent with this Order, are hereby repealed or modified accordingly.
Section 7. Effectivity. This Order shall take effect immediately.
